Acceptance by the customer
These general terms and conditions of sale apply automatically to all sales contracts with Grands Bourgognes concluded online on the website www.grandsbourgogne.com and prevail over all other general terms and conditions, unless otherwise agreed in writing by Grands Bourgognes. By placing an order, the customer fully and unreservedly accepts the following provisions.Product presentation
The characteristics of the products offered for sale are described on the website or in printed materials, in French. The products comply with French legislation and it is the customer's responsibility to find out about the legislation of the foreign country in the event of delivery outside France. Photographs, drawings, etc. are not contractually binding. Grands Bourgognes cannot be held liable for any errors therein.Article 3 - Ordering
Offers reserved for private customers and limited to available stock. Offers on the website are reserved for private customers. For professionals, Grands Bourgognes provides a dedicated sales department (Contact: 03.80.79.29.90). Due to the specific nature of the business and direct online sales via the website, all offers presented by Grands Bourgognes (online or paper catalogue, email, fax, post, etc.) are subject to availability, non-binding and except for sales currently being processed. Furthermore, given the rare or speculative nature of certain products, restrictions on the quantities available per household (same name, same address) may apply.Ordering
The customer selects the desired products and services and submits their order using the order form available on the website, following the instructions. Acceptance of the general terms and conditions of sale is formalised during this process by clicking on the "order confirmation" button, and the order is considered final upon full payment of the price. An order confirmation is sent to the customer's email address provided when placing the order. In the event that Grands Bourgognes is unable to fulfil all or part of the customer's order for the reasons indicated above (see Article 3, "Offers reserved for private customers and limited to available stock"), the customer will be contacted as soon as possible to discuss an alternative solution.Article 4 - Price
The price, stated in euros on the order form, is final, inclusive of all taxes and including VAT at the rate applicable at the time of sale. Product prices include normal handling, packaging and storage costs. Transport costs in the event of delivery by Grands Bourgognes are indicated separately, in addition to the price of specific services in the event of special requests.Article 5 - Payment & Invoicing
Payment for products and services is made in cash by credit card via the secure procedure set up on the website. The customer undertakes to provide all the information necessary for secure online payment. A paid invoice detailing the various items in the order will be sent to the customer as soon as Grands Bourgognes has received payment. We do not store our customers' credit card details.Article 6 - Collection, Delivery & Receipt
If no delivery request is made, the customer will be deemed to have chosen to collect the products from the shop, possibly by a third party designated by them, within a reasonable period of time. Failing this, the customer will be notified and, if necessary, given formal notice. In the event of a delivery request specified by the customer, Grands Bourgognes undertakes to make every effort to ensure that the products are delivered as quickly as possible. Average delivery times are specified and vary according to the destination chosen by the customer. Exceeding the delivery time shall not give rise to damages, deductions or cancellation of the current order. However, if one month after the customer's written complaint regarding the delay, the products have still not arrived, the sale may be cancelled at the initiative of either party by registered letter with acknowledgement of receipt. The customer will then receive a refund of their payment, to the exclusion of any other compensation or damages, within one month at the latest. Delivery is made by direct handover to the recipient at the address indicated by the customer or, in the event of absence, by notice of availability. Upon receipt of the products, it is the recipient's responsibility to check the parcel(s). In the event of a problem (error, missing items, damage, etc.), the customer has 48 hours to make any reservations to the carrier in writing, describing the situation in detail. The customer shall send a copy to Grands Bourgognes, who will act as quickly as possible to find a solution. Shipping costs are based on the number of bottles, in 0.75l equivalents. A magnum (150 cl), for example, is equivalent to 2 bottles (2 x 75 cl). Please refer to the price list below. Unless otherwise stated, shipping costs are always borne by the customer. The website www.grandsbourgognes.com delivers products sold only to mainland France. No shipments are made outside these geographical areas. Grands Bourgognes' partner carriers are Colissimo and Geodis Calberson. Shipments are made from Monday to Thursday, except on public holidays and days when Grands Bourgognes is closed. No orders are shipped on Fridays to avoid the goods being stored unnecessarily over the weekend at our carrier's premises in conditions that are unsuitable for the proper preservation of wine. Orders placed on weekends or public holidays or days when Grands Bourgognes is closed are validated on the next working day.Article 7 - Right of withdrawal
In accordance with the legislation governing mail order sales applicable to online sales, the customer has a period of 7 clear days from the delivery of their order to return the product to Grands Bourgognes for exchange or refund, without penalty, with the return costs being borne by the customer. As an exception, these provisions do not apply to orders for products that have been personalised or for which the customer has made a specific request when placing their order (special formats, personalised packaging, etc.). If the seven (7) clear day period expires on a Sunday or other public holiday or non-working day, the period is extended to the next working day. The product returned by the customer must be in its exact condition (unopened bottles, undamaged caps and labels) accompanied by its original packaging and the original invoice. The risks incurred by the products during return to the website www.grandsbourgognes.com are borne by the customer.Article 8 - Transfer of risks & retention of title clause
The transfer of risk takes place at the time of collection from the store or delivery of the products if the latter is provided by Grands Bourgognes. The products remain the property of Grands Bourgognes until the day of their complete collection.Article 9 - Applicable law - Disputes & Competent Court
The contract is subject to French law. Complaints or disputes will be examined carefully. In the event of a dispute, an amicable solution will always be preferred. In the absence of an amicable agreement, the Commercial Court of Dijon shall have jurisdiction.Article 10: Data Processing, Files & Freedoms
Security of your credit card details
All banking information that the customer is required to provide to the www.grandsbourgognes.com website is neither stored nor visible on the Internet. Similarly, this banking information is neither stored nor visible on the servers of the www.grandsbourgognes.com website. In view of this, customers are asked to enter their banking information for each order. Grands Bourgognes guarantees the security of your bank details thanks to the Banque Populaire's CyberPlus system. Payment security is based on merchant authentication (Cyberplus Payment certificate issued by Banque Populaire), confidentiality and integrity of exchanges. This means that credit card numbers are never transmitted unencrypted over the internet. Each transaction is associated with an authorisation request made to the CB bank card network, which verifies that the card exists, that it has not been blocked and that the account is solvent. Before each bank card payment, Cyberplus Paiement authenticates the merchant's site using a certificate issued by Banque Populaire during installation. During the various exchanges between the merchant, the user and the payment server, data is never transmitted unencrypted over the network but is encrypted using SSL protocol, and a key or padlock icon appears in the user's browser.
